NOTICE OF SUCCESSOR TRUSTEE’S SALE
Default having been made in the payment of the debts and obligations as made, provided for and/or secured in a Deed of Trust executed by CHRISTOPHER DON KIRKLAND a/k/a CHRISTOPHER D. KIRKLAND and wife, CRYSTAL L. KIRKLAND, to Larry L. Hicks, Trustee, dated May 15, 2010, and recorded in Trust Deed Book Q-28, page 697 in the Register’s Office for Monroe County, Tennessee, and the entire indebtedness having been declared due and payable and payment not having been made as demanded. Notice is hereby given that I, John Carson III, having been appointed Successor Trustee under the authority vested in me by said instrument, and having been requested to do so by the lawful holder and owner of said indebtedness will on August 21, 2014, at 11:00 a.m. on the steps of the Monroe County Courthouse, sell at public outcry, to the highest bidder and last bidder for cash, free from all statutory and other rights and equities of redemption to the extent provided for in T.C.A. ¤66 8 101, as amended and free from the rights of homestead and all other exemptions of any kind, which are waived in said Deed of Trust, but subject to any state tax liens and subject to any unpaid city or county property taxes and all other matters and encumbrances which take priority over the Deed of Trust under which this foreclosure sale is conducted, the following described property being located in Monroe County, Tennessee, and being more particularly described as follows:

LOCATED in the THIRD Civil District of Monroe County, Tennessee, and at the Northeast side of the cul de sac on Kirkland Drive as shown on survey for Christopher Kirkland by Paul Lingerfelt, TN RLS #771, 109 County Road 325, Sweetwater, Tennessee 37874, dated January 24, 2007 and being Drawing No. 07016 as shown in Plat Cabinet F, Slide 240, in the Register’s Office for Monroe County, Tennessee. Also see Corrected Plat dated February 2, 2007 correcting adjoining property owners names and recorded in Cabinet F, Slide 241, in the Register’s Office for Monroe County, Tennessee, and being more particularly described as follows:

BEGINNING at iron pin found in the line of Stricklan and Charles Kirkland; thence running South 21 degrees 33 minutes East 531.6 feet to a metal fence post; thence South 70 degrees 24 minutes West 384.6 feet to a point in the cul de sac; thence North 17 degrees 36 minutes West 261 feet to a set iron pin; thence North 30 degrees 07 minutes East 215 feet to a metal fence post, corner with Hindman and Kirkland; thence North 36 degrees 17 minutes East 234.3 feet to a found iron pin and being the point of Beginning. Said property containing 3.45 acres.

ALSO CONVEYED herewith and the above described property is conveyed subject to a FIFTY (50) FOOT non-exclusive road easement known as Kirkland Drive from Kincaid Road to the property hereinabove described, said easement being a covenant running with the land.

LYING AND BEING situated in the Third Civil District of Monroe County, Tennessee, and being more particularly described as follows, to-wit:

BEGINNING at the Eastern most corner of the tract herein conveyed at a set iron pin corner on the Northern edge of Kincaid Road, corner with Tommy Self; thence along the Northern edge of Kincaid Road, South 87 degrees 36 minutes West 53.1 feet to a set iron pin corner with Jeff Lunnemann; thence with Lunnemann, North 22 degrees 10 minutes West 192. 2 feet to a point; thence continuing North 19 degrees 29 minutes West, first with Lunnemann, and thence with James Swanson and Zachary Ellis a total distance of 751.5 feet to a point on the Southwestern edge of a cul-de-sac; thence along the cul-de-sac first with Ellis and thence with Hindman on a curve to the right, with a radius of 55.9 feet, a length of 176 feet on a chord reading of North 07 degrees 41 minutes East 111.8 feet to a set iron pin corner with Hindman and other property of Grantee; thence with other property of Grantee, South 19 degrees 02 minutes East 23.5 feet to a corner with Phillip Axley; thence with Axley, South 19 degrees 02 minutes East 110.5 feet to a metal fence post corner with Mark Watson; thence South 19 degrees 29 minutes East first with Watson and thence with Bivens, a total distance of 715.8 feet to a corner with Self; thence with Self, South 22 degrees 10 minutes East 209.0 feet to the point of BEGINNING, containing 1.04 acres according to the survey of Paul Lingerfelt, RLS # 771, dated 01/24/07 and being drawing #07016 to which reference is here made.

This tract is SUBJECT to an easement heretofore granted to the following persons over and upon the above described tract: [1] Mark Watson by Warranty Deed of record in W.D. Book 242, Page 280, in said Register’s Office; [2] Donnie R. Kirkland by Warranty Deed of record in W.D. Book 253, Page 215, in said Register’s Office (now owned by Zachary Ellis, see W.D. Book 305, Page 629); [3] Tabitha A. Hindman by Warranty Deed of record in W.D. Book 254, Page 322, in said Register’s Office; [4] Herbert Barry Duncan by Warranty Deed of record in W.D. Book 246, Page 635, in said Register’s Office (now Floyd Tharp, see W.D. Book 268, Page 362); and [5] the Grantee herein by Warranty Deed of record in W.D. Book 244, Page 169, in said Register’s Office.

This conveyance includes a private water line located thereon.

This conveyance is made SUBJECT to all visible easements or rights-of-way, whether private or public.

The undersigned shall convey only as Successor Trustee without covenants or warranty of title. This is an action to collect a debt and any information obtained will be used for this purpose.
Should the highest bidder fail to comply with the terms of the bid at the public sale, then the Successor Trustee shall have the option of accepting the next highest bid with which the buyer is able to comply. The right is reserved to adjourn the day of the sale to another day certain without further publication, upon announcement at the time set forth above. The sale held pursuant to this notice may be rescinded by the Successor Trustee’s option at any time.
